Security for a loan needs careful consideration as the type of security needs to be tailored to the circumstances and issues of stamp duty, registration requirements (and timing thereof) require careful attention. In particular, the Personal Property Securities Act 2009, has created new requirements for registration and enforcement but has given the opportunity for what are generally known as retention of title clauses to be registered and have priority over other securities in certain circumstances.
