Elder abuse is a single or repeated act or lack of appropriate action, occurring within any relationship where there is an expectation of trust, which causes harm or distress to an older person. This can include physical, psychological, emotional, sexual or financial abuse and can include intentional or unintentional neglect.

It can be overlooked – perhaps this is due to ageism that exists in our culture, perhaps it is too threatening for people to deal with. No elderly person should live in an unsupportive or abusive environment, nor should relatives of the elderly have to bear any uncertainty about the level of care their loved one is receiving.

Another issue that arises in elder abuse is a misuse of an enduring power of attorney whereby the attorney uses their position to benefit themselves and does not act in the best interest of the principal. This is what is known as a breach of a “fiduciary” duty and can lead to serious charges by the court.
